Understanding RERA

The Real Estate (Regulation and Development) Act, 2016 provides a regulatory framework for covered residential and commercial real estate projects. It supports project registration, promoter disclosures, accountability and formal mechanisms for complaints, compensation and appeals.

The Act does not automatically govern every property disagreement. The registration status of the project, applicable exemptions, identity of the parties and nature of the alleged violation should be examined before selecting a forum.

For disputes involving wider Uttar Pradesh real estate issues, the UP RERA legal support page provides additional information about builder-buyer claims and regulatory proceedings.

Rights and Responsibilities Under RERA

RERA provides protections for allottees while placing defined obligations on promoters, real estate agents and buyers. Promoters are generally expected to follow sanctioned plans, disclose project information and meet contractual and statutory duties.

Allottees also have responsibilities relating to agreed payments, participation in conveyance formalities and compliance with the agreement for sale. The legal position should therefore be assessed using both the applicable law and the transaction documents.

Section 31 permits an aggrieved person, including an association of allottees, to file a complaint regarding an alleged violation against a promoter, allottee or real estate agent.

Role of UP RERA in Noida

Noida is located within Gautam Buddh Nagar district, and covered real estate projects in the area fall under the Uttar Pradesh Real Estate Regulatory Authority. The official portal contains project registrations, promoter information, agent records, complaint services, cause lists and order-related facilities.

UP RERA maintains an NCR regional office in Greater Noida. Its official complaint format also refers to proceedings before the Lucknow or Gautam Buddh Nagar bench, depending on territorial jurisdiction.

Its functions and online facilities include:

  • Registering covered real estate projects and agents
  • Maintaining project and promoter disclosures
  • Receiving general and compensation complaints
  • Providing complaint-status and cause-list information
  • Facilitating requests for execution of UP RERA orders

UP RERA provides separate options for registering a general complaint and a complaint seeking compensation. It also permits online execution requests where an order has not been complied with.

Frequently Asked Questions

A complaint may be considered where the promoter does not provide possession by the date stated in the agreement. Depending on the facts, an allottee may seek to withdraw and claim a refund or continue with the project and seek prescribed interest for the delay.

Section 18 addresses remedies where the promoter fails to complete the project or give possession according to the agreement. The appropriate option depends on the contract, payment position, project status and allottee’s objectives.

Common documents include the sale agreement, allotment letter, payment receipts, builder emails, brochures, possession promise, legal notice and project related communication.

The official UP RERA portal provides a project-search facility containing registration and promoter information. Projects may be searched using available details such as the project name, registration number, promoter or district.

The registered project record should be compared with the documents supplied by the promoter, including the promised completion date, approved details and development phase.

A complaint may be available where a project required registration but was marketed or sold without it. The project size, phase, approval status and any applicable exemption should first be checked.

Specified defects reported within five years of possession must generally be rectified by the promoter without further charge within thirty days. The provision may not cover every minor maintenance issue.

Certain changes to an individual unit require prior consent, while other alterations to sanctioned plans or common areas may require written consent from at least two-thirds of the allottees.
